Terms of Service

Effective Date: September 19, 2026 | Last Updated: September 19, 2026

Please read these Terms carefully. These Terms of Service (“Terms”) form a legally binding agreement between you and Lexie Group LLC, a Pennsylvania limited liability company (“Company,” “we,” “us,” or “our”), which operates Dear Lexie (the “Brand”), the website located at dearlexie.com, and all related content, features, submissions functionality, and social media channels (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, Disclaimer, and Submission & User-Generated Content Terms, each incorporated by reference. If you do not agree, do not use the Services.

1. Who We Are and What the Services Are

Dear Lexie is an entertainment, advice, and commentary brand operated by the Company. Through the Services, users may submit questions, letters, and messages, and “Lexie” — an editorial persona and brand operated by the Company — may respond with opinions, reactions, and general commentary that are published across the Website and the Company’s associated social media channels.

The Services are provided for general entertainment and informational purposes only. See the Disclaimer for important limitations.

2. Eligibility and Age Requirement

The Services are intended for, and may only be used by, individuals who are at least eighteen (18) years of age. By using the Services, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms. We do not knowingly permit use of the Services by anyone under 18.

3. Acceptance and Changes to These Terms

We may modify these Terms at any time. When we do, we will update the “Last Updated” date and, where appropriate, provide additional notice. Changes take effect when posted. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

4. Your Account and Communications

Some features may require you to submit an email address or create an account. You are responsible for the accuracy of information you provide and for maintaining the confidentiality of any credentials. You agree that we may contact you electronically regarding the Services and, where you have opted in, for marketing purposes. You may opt out of marketing communications at any time.

5. Submissions and User Content

The Services allow you to submit questions, letters, and messages and, where enabled, comments, votes, and other materials (collectively, “User Content”). All User Content is governed by our separate Submission & User-Generated Content Terms, which describe the license you grant to us and the promises you make when you submit. By submitting User Content, you agree to those terms.

We are not obligated to publish, respond to, retain, or use any User Content, and we may edit, shorten, anonymize, decline, remove, or delete any User Content at our discretion.

6. Acceptable Use

You agree not to use the Services to do any of the following:

Violate any law or the rights of any person, including privacy, publicity, or intellectual-property rights;

Submit content that is unlawful, defamatory, harassing, threatening, abusive, hateful, obscene, or that promotes violence or self-harm;

Impersonate any person or misrepresent your affiliation with any person or entity;

Submit content you know to be false about an identifiable real person, or that discloses another person’s private information without their consent;

Upload viruses or malicious code, or attempt to gain unauthorized access to the Services or related systems;

Scrape, harvest, or collect data from the Services except as expressly permitted;

Manipulate, automate, or otherwise interfere with any voting, rating, ranking, or comment feature; or

Use the Services in any way that could disable, overburden, or impair them.

7. Intellectual Property; Our Marks

The Services and all content we create — including the Dear Lexie name and logo, the advice, opinions, responses, and commentary published under the “Lexie” name and persona, text, graphics, audio, video, design, and software — are owned by or licensed to the Company and are protected by copyright, trademark, and other laws. “Dear Lexie” and “Dear Lexie” and related names and logos are trademarks of Lexie Group LLC. Except as expressly permitted, you may not copy, reproduce, distribute, publicly display, or create derivative works from our content without our prior written permission.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

8. Third-Party Links and Services

The Services may contain links to third-party websites, platforms, and services (including social media). We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is governed by their terms and policies, not ours.

9. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any content is accurate or complete. Please also read the separate Disclaimer, which is incorporated here by reference.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owners, members, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your User Content, your use of the Services, or your violation of these Terms or of any law or third-party right.

12. Copyright / DMCA

We respect intellectual-property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act. Our full notice-and-takedown procedure and designated agent are set out in the DMCA / Copyright Policy below.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including intellectual-property, disclaimer, liability, indemnification, and dispute-resolution provisions) will survive.

14. Dispute Resolution; Binding Arbitration; Class-Action Waiver

Please read this section carefully — it affects your legal rights. First, informal resolution: before starting any formal proceeding, you agree to contact us at legal@dearlexie.com and attempt to resolve the dispute informally for at least thirty (30) days.

Binding arbitration: except for the exceptions below, any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The arbitration will be held in or near Philadelphia, Pennsylvania, or conducted remotely, and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver: you and the Company agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Exceptions: either party may (a) bring a qualifying claim in small-claims court, and (b) seek injunctive or equitable relief for intellectual-property infringement or unauthorized access in a court of competent jurisdiction.

30-day opt-out: you may opt out of this arbitration agreement by sending written notice to legal@dearlexie.com within thirty (30) days of first accepting these Terms, stating your name and intent to opt out.

15. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Subject to the arbitration provision above, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to the jurisdiction of those courts.

16. Miscellaneous

These Terms, together with the policies incorporated by reference, are the entire agreement between you and the Company regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. Headings are for convenience only.

Privacy Policy

Effective Date: September 19, 2026 | Last Updated: September 19, 2026

This Privacy Policy explains how Lexie Group LLC (“we,” “us,” or “our”) collects, uses, and shares information in connection with Dear Lexie and the website at dearlexie.com and related services (the “Services”). By using the Services, you agree to this Policy.

1. Information We Collect

Information you provide directly. This includes any question, letter, or message and other User Content you submit; your name or display name; your email address; and any other information you choose to include in a submission, comment, or message. Because submissions may be published, please do not include information you are not comfortable making public.

Information collected automatically. When you use the Services, we and our providers may automatically collect device and usage data such as IP address, browser type, device identifiers, pages viewed, referring/exit pages, and interaction data (including votes, ratings, and clicks), through cookies and similar technologies. See our Cookie Policy.

Information from third parties. If you interact with us through social media or engage our analytics or advertising partners, we may receive limited information from those platforms in accordance with their policies and your settings.

2. How We Use Information

To operate, maintain, and improve the Services;

To review, publish, respond to, edit, anonymize, and moderate User Content;

To tabulate responses and engagement and to display results and related content;

To communicate with you, respond to inquiries, and send administrative or, where you opt in, marketing messages;

To analyze usage, measure performance, and develop new features and content;

To protect the security and integrity of the Services and to detect and prevent fraud or abuse; and

To comply with law and enforce our Terms and policies.

3. How We Share Information

Publicly. User Content you submit (as edited or anonymized) may be published on the Website and social media and may be viewed, shared, and re-published by others.

Service providers. We share information with vendors who perform services for us — such as hosting, analytics, email delivery, and content moderation — under obligations to protect it.

Legal and safety. We may disclose information to comply with law, respond to lawful requests, enforce our Terms, or protect the rights, safety, and property of the Company, our users, or the public.

Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

We do not sell your personal information for money. Certain uses of cookies for analytics or advertising may be considered a “sale” or “sharing” under some state laws; see Your Rights below and our Cookie Policy.

4. Cookies and Tracking

We use cookies and similar technologies to run the Services, remember preferences, measure traffic, and understand engagement. You can control cookies through your browser and, where offered, our cookie controls. For details, see the Cookie Policy.

5. Data Retention

We retain information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Published User Content may remain available indefinitely, including after you stop using the Services, and copies may persist in archives, caches, or with third parties who accessed it.

6. Security

We use reasonable administrative, technical, and physical safeguards to protect information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

7. Children’s Privacy

The Services are intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18, and we never knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (COPPA). If you believe a child has provided us information, contact privacy@dearlexie.com and we will delete it.

8. Your Privacy Rights

U.S. state privacy rights. Depending on your state of residence (for example, California, Colorado, Connecticut, Virginia, Utah, and a growing number of others), you may have rights to know or access the personal information we hold about you, to correct or delete it, to obtain a portable copy, and to opt out of targeted advertising or any “sale” or “sharing” of personal information. California residents may also request information about disclosures and are entitled to non-discrimination for exercising their rights.

EU/UK rights. If you are in the European Economic Area or the United Kingdom, you may have rights to access, rectify, erase, restrict, or object to processing, and to data portability, subject to applicable law.

To exercise any right, contact us at privacy@dearlexie.com. We will verify and respond as required by applicable law. You may also have the right to appeal a denied request or to lodge a complaint with a regulator.

9. Do Not Track

Some browsers offer a “Do Not Track” signal. Because there is no common industry standard, we do not currently respond to such signals. Where required, we honor recognized opt-out preference signals (such as Global Privacy Control) as an opt-out of sale/sharing.

10. Changes to This Policy

We may update this Policy from time to time. Changes take effect when posted, and we will update the “Last Updated” date. Material changes may be accompanied by additional notice.

4. How to Control Cookies

You can manage cookies through your browser settings, which usually let you block or delete cookies. Blocking some cookies may affect how the Services function. Where required, we provide a cookie banner or preference center so you can accept or reject non-essential cookies, and we honor recognized opt-out preference signals where applicable.

5. Changes

We may update this Cookie Policy from time to time. The “Last Updated” date shows when it was last revised.

2. No Reliance

Submission & User-Generated Content Terms

Effective Date: September 19, 2026 | Last Updated: September 19, 2026

These Submission & User-Generated Content Terms (“Submission Terms”) apply whenever you submit a question, letter, or message, comment, or any other material to Dear Lexie (“User Content”). They are part of our Terms of Service. By submitting User Content, you agree to these Submission Terms. If you do not agree, do not submit anything.

1. License You Grant to Us

By submitting User Content, you grant Lexie Group LLC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, transferable, and sublicensable license to use, host, store, reproduce, edit, adapt, translate, excerpt, combine with other content, create derivative works from, publish, publicly display and perform, distribute, and otherwise exploit your User Content, in whole or in part, in any and all media now known or later developed, for any purpose, including editorial, promotional, and commercial purposes (such as the Website, social media, video, audio, newsletters, and compilations).

This license survives even if you stop using the Services or ask us to remove your User Content, to the extent your User Content has already been published, shared, incorporated into other works, or retained in backups or archives.

2. No Compensation

Unless we agree otherwise in a signed writing, you will not receive any payment, credit, or other compensation for your User Content or for our use of it.

3. We May Edit, Anonymize, or Decline

We are under no obligation to use your User Content. We may edit, shorten, rewrite for clarity, anonymize, remove identifying details, combine, decline, remove, or delete any User Content at any time and for any reason, at our sole discretion. Where practical for submitted questions, letters, and messages, we will generally publish them without your full name unless you ask us to use it, but we cannot guarantee anonymity.

4. Your Promises (Representations and Warranties)

You represent and warrant that:

You are at least 18 years old and have the right and authority to submit the User Content and grant the license above;

You own the User Content or have all necessary rights, licenses, and permissions to submit it and grant these rights;

The User Content does not infringe or violate any third party’s intellectual-property, privacy, publicity, or other rights;

You have obtained the consent of any identifiable person you describe or quote, or you have sufficiently disguised their identity so they are not reasonably identifiable;

The User Content is not unlawful, defamatory, harassing, obscene, or otherwise in violation of our Community Guidelines; and

Any statements of fact in your User Content are, to the best of your knowledge, true.

5. Sensitive Information

Do not submit information you do not want made public, and do not submit anyone’s sensitive personal data (such as financial-account numbers, government identifiers, or health information) or private contact details. You are responsible for what you choose to share.

6. Waiver of Moral Rights and Name/Likeness Release

To the extent permitted by law, you waive any “moral rights” in your User Content and any right to inspect or approve how it is used. You also consent to our use of any name, username, voice, statements, and likeness contained in your User Content in connection with the Services and their promotion, without further notice, approval, or compensation.

7. Release

You release the Company and its owners, members, officers, employees, agents, and licensees from any claims arising out of our use of your User Content as permitted by these Submission Terms, including claims for defamation, invasion of privacy, right of publicity, or emotional distress.

8. Feedback

If you send suggestions or ideas about the Services (“Feedback”), you grant us an unrestricted right to use the Feedback for any purpose without any obligation to you.

9. How to Submit

Submit User Content through the forms and channels provided on the Services or to submissions@dearlexie.com. By submitting, you confirm you have read and agree to these Submission Terms.
